Terms and conditions

These General Terms and Conditions apply to all legal relationships and agreements between Kustvillas and the holiday guest/tenant.

1) REQUEST

Website information
The information about our holiday homes on our website has been compiled with care. It is possible that due to circumstances, the description or photos may no longer fully correspond to the current situation. As long as these are not significant differences, you cannot hold us accountable for them. However, if there are major differences, we would appreciate if you let us know.
OTA = Online Travel Agency
Kustvillas authorizes OTAs to offer holiday homes that are bound by contract on OTA platforms. All inquiries, reservations, cancellations, and any issues should be handled through the booked OTA.

 

2) RESERVE

Kustvillas only accepts reservations from individuals who are 18 years or older. The renter must be 18 years or older and present during the stay. Kustvillas reserves the right to refuse a reservation at any time, without providing reasons. A confirmation by email constitutes a reservation and will be scheduled in our agenda. If you fail to show up, there will be consequences. Kustvillas will confirm the reservation digitally to you within 14 days of receiving it, accompanied by an invoice. If you do not have an email address, you will receive the same document by post. You are required to check the invoice for accuracy upon receipt. Any alleged discrepancies or inaccuracies must be reported in writing no later than 10 days after the invoice's receipt date and before the start of the stay. If you do not receive an invoice within 14 days of the reservation, you should immediately contact desk@kustvillas.be or call +32 59 79 06 06.

Guest information
The information we request from you and your travel party is necessary for the reservation. You can find information on how we handle this data in our cookie and privacy policy.
If you or any member of the travel party have any mental or physical conditions, we can only take them into account if we are informed prior to the reservation and have explicitly agreed to it.

3) PRICES

 

Prices can be requested at any time by sending an email to desk@kustvillas.be or by contacting us at +32 59 79 06 06. Since certain elements included in the price are subject to periodic review, such as (but not limited to) energy costs, cleaning, etc., Kustvillas reserves the right to change prices and/or charge a surcharge at any time. Upon reservation, you will be informed of the applicable price at that time. The price stated on the invoice is binding. Price discounts and/or special offers cannot be applied if the invoice has been sent by Kustvillas.
The rental price of each villa includes normal consumption of water, gas, and electricity, VAT, and final cleaning.

The rental price of each villa does not include:
- Beds made and towels (available at an additional cost, if desired)
- The following are not included in the (final) cleaning: washing dishes, removing and gathering any rented bath and bed linen, and disposing of waste in garbage bags.
- Unusual or excessive consumption of utilities resulting from actions taken by the tenant or holiday guests, such as excessive use of personal devices.

Pets
Not all accommodations allow pets, please contact us to verify if your pet is welcome. If allowed, you must communicate this in advance via email to Kustvillas. Kustvillas reserves the right to assess on a case-by-case basis whether the specific pets are permitted or declined. Your pet must be free from any pests. If any damage is caused or if the house, garden, and terrace are not left clean, charges will apply starting from a minimum of 100 euros. We charge 20 euros for one pet and 40 euros for two pets.

4) BATH AND BED LINEN

Kustvillas offers its holiday guests the option to rent bath and bed linen, including a fitted sheet and duvet cover per person, as well as 2 bath towels per person. This should be requested in advance with Kustvillas. If the holiday guest wishes to have the beds made upon their arrival, there is an additional charge of €20 per person. If Kustvillas only needs to provide the bed linen (without making the beds), there is an additional charge of €15 per person.

5) PAYMENTS
The travel amount is paid in euros. This applies to bookings made directly with Kustvillas.

Payment term
The full amount must be paid 100% after reservation by the specified due date.
In case of non-payment or incomplete payment of the invoiced amounts, you will be in default. Kustvillas will send you a payment reminder. If the amount is not received by Kustvillas within 14 days after the reminder, Kustvillas is entitled to unilaterally terminate the agreement by means of a written notice or email to you. You are liable for all damages that Kustvillas suffers or will suffer as a result, including all costs incurred by Kustvillas in connection with your reservation and the termination. Payments must be received by Westkustvillas no later than 14 days after the date of the reminder or termination. After the termination of the travel agreement, other guests can reserve the holiday home, and we cannot guarantee the availability of the holiday home for guests with late payments.

Deposit and additional costs
For some holiday homes, a security deposit is applicable. Additionally, there may be additional costs for items such as bath and bed linen. The method of payment for the security deposit and/or additional costs will be mentioned in the email.

6) CHANGE FEES

If, after the reservation has been made, you wish to make changes to the reservation, Kustvillas is not obligated to comply with those changes. It is at the discretion of Kustvillas to decide whether and to what extent those changes are accepted. For any changes made up to a maximum of 4 weeks prior to arrival in an existing reservation, we charge a €25 modification fee. These fees will not be charged if you make an additional booking or change to a more expensive period or villa. In principle, changes cannot be allowed within 4 weeks before arrival. In case of a change to a cheaper period or villa or (partial) cancellation within the period of 2 weeks prior to the start of the stay, you will be liable for the full rental amount.

7) CANCELLATION

In case of cancellation of your booking directly with Kustvillas, the following provisions apply:
- An administrative fee of 10% of the total amount is due to Kustvillas in case of cancellation more than 3 weeks before the planned start date of the stay.
- In case of cancellation within 3 weeks before the planned start date, a cancellation fee of 30% of the total accommodation cost is applicable.
- In the event of cancellation within 1 week or less before the planned start date, the full accommodation cost is due. The payment of the specified amount under "7 Cancellation" must be received by Kustvillas no later than 14 days after the invoice date.

 

8) ARRIVAL, STAY AND DEPARTURE

Arrival
- At least one week before the planned start date of your stay, you will receive an email with the final instructions for your arrival.
- If the holiday guest has rented bath and bed linen (see further details), payment should be made in cash upon arrival.
- Typically, check-in is between 16:00 and 20:00. If this is different for your stay, we need to be informed in advance.
- Upon arrival at the holiday villa, the holiday guest will receive 1 or 2 keys to the property, depending on the accommodation.
Stay
The holiday guest is required to occupy and maintain the holiday villa as a good householder.
- This also includes properly locking the holiday villa when leaving it during the vacation stay.
- The energy costs are included in the holiday accommodation, but the holiday guest should still ensure that the consumption of water, gas, and electricity is done responsibly, as a good householder would do.
- The owner specifies the maximum number of people allowed to stay in the holiday home in the house description on the website. This number should not be exceeded under any circumstances.

Departure
- The departure time will be communicated, and you will be requested to check out by that time. If you do not leave the holiday home on time, we will charge additional costs.
- In case bath and bed linen were rented, upon departure from the holiday villa, the holiday guest should remove and gather the bed linen (fitted sheet and duvet cover) on the bed. Additionally, the bath linen should be grouped together and placed in the bathrooms.
- All garbage should be sorted and grouped in the garage or designated area. Common types of waste include residual waste, PMD (plastic, metal, and drink cartons), glass, paper, and cardboard.
- All furniture should be returned to its original arrangement if it was changed by the holiday guest during their stay. The property should be left clean.
- In case of missing keys to the holiday villa upon departure, they will be charged at €50 per lost key.
- Any form of damage, regardless of its size, should be reported.

9) HOUSEHOLD RULES

All guests are required to abide by the House Rules. The House Rules are available in every holiday villa and can be easily accessed in the information folder. Violation of the House Rules may result in eviction from the villa, without any refund of the rental amount or a portion thereof. In this case, there is no entitlement to any compensation.

10) DAMAGE

The rented holiday home must be occupied by the tenant, their co-tenants, or their visitors with the necessary care and diligence, while respecting the peace of the surroundings. (Bachelor parties or other wild parties are not allowed.) Report any damage to Kustvillas as soon as possible. If the guest causes damage in or around the holiday home, please report the damage to a Kustvillas staff member as soon as possible. In this case, you are liable for the damage. We are also not liable for damages resulting from circumstances caused by you, your travel companions, or third parties. When damage is discovered after the departure of the main tenant, they must accept the decision of the owner. Smoking: Smoking inside the property is strictly prohibited. Smoke detectors are installed, and fire extinguishers are provided in the property. Additional charges will apply in case of a smoke smell.

11) FORCE MAJEURE

Force majeure exists when the performance of the agreement, in whole or in part, is entirely or partially prevented, temporarily or otherwise, by circumstances beyond the control of Westkustvillas, including but not limited to, war, labor strikes, blockades, fire, pandemic, floods, and other disruptions or events. During such a situation, both parties, Westkustvillas and the tenant, are expected to act reasonably. Westkustvillas will offer reasonable proposals at all times, and the tenant is required to accept them. Full refunds are not possible in this case but can be converted into vouchers with a minimum validity period of 12 months. If no agreement can be reached, the cancellation conditions outlined in clause 7 should be followed.

12) LIABILITY

Kustvillas does not accept liability for:
- Theft, loss, or damage of any kind during or as a result of a stay in one of our holiday villas.
- The malfunctioning or disabling of technical equipment. The holiday guest and those accompanying them are jointly liable for any loss and/or damage that may arise for Westkustvillas as a direct or indirect result of their stay, regardless of whether it was caused by their own actions or omissions or by third parties present in the holiday villa at their behest, as well as for any damage caused by any animals and/or objects they have in their possession. In case of improper use (and therefore improper leaving of the villa), additional (cleaning) costs may be charged.

13) COMPLAINTS

Despite all the care taken by Kustvillas, it is possible that you may have a legitimate complaint. You must report this complaint on-site as soon as possible and no later than upon your departure, to give Westkustvillas the opportunity to resolve the issue immediately. If the complaint is not handled to your satisfaction, you have up to 14 days after the departure from the holiday villa to submit the complaint in writing via email to desk@kustvillas.be. If you did not book directly with Kustvillas, you should contact your OTA (Online Travel Agency).

14) GENERAL

All disputes fall under the jurisdiction of the court located in the place where the holiday home is situated, namely the courts of the Veurne jurisdiction, with exclusive application of Belgian law. These General Terms and Conditions apply to all reservations, whether made directly or indirectly with Westkustvillas. The content of the (digital) publications of Westkustvillas is subject to change. In case of any discrepancies, the digital version of the General Terms and Conditions of Westkustvillas (available at www.kustvillas.be) takes precedence over the printed version.

15) GDPR LEGISLATION

Kustvillas complies with the requirements set forth in the GDPR legislation. All identification data will be kept by Kustvillas for internal use only. They will be used solely for our standard business operations and the provision of our services. At any time, the customer can request to access, modify, or delete all identification data. We take all necessary measures to protect and treat these data as confidential.
